Privacy Policy

How Keller Williams Cayman Islands collects, uses, protects, and shares personal data.

Our Commitment to Your Privacy

We handle personal information with care, confidentiality, and respect. This policy is written to be clear for clients while giving KW Cayman the practical protections needed to operate a modern real estate business.

1. Scope and who we are

Keller Williams Cayman Islands (“KW Cayman”, “we”, “us”, or “our”) is a Cayman Islands real estate brokerage. This Privacy Policy explains how we collect, use, disclose, store, transfer, and protect personal data when you visit kellerwilliams.ky, contact us, submit a lead or enquiry, subscribe to updates, request a valuation, browse listings, apply for career opportunities, or otherwise interact with us.

This Policy is designed to reflect the Cayman Islands Data Protection Act, 2021 revision and its core privacy principles, as well as broadly recognised international privacy standards. Where another privacy law applies to you, we will honour any rights that law gives you to the extent required.

This website and our services are intended for adults and business/real-estate related enquiries. We do not knowingly collect personal data from children.

2. Personal data we collect

We may collect personal data directly from you, automatically through the website, from our agents or team members, from public or industry sources, and from third-party service providers involved in real estate transactions.

Depending on your interaction with us, this may include: name, email address, phone number, mailing address, contact preferences, property interests, listing and valuation details, budget or price range, buying/selling/renting timelines, relocation needs, messages you send us, newsletter preferences, career/application information, and any information you choose to provide in a form or conversation.

For website security, analytics, lead routing, and fraud prevention, we may also collect technical information such as IP address, approximate location derived from network data, device/browser information, pages viewed, referring pages, dates/times of visits, form source, and similar usage data.

In a real estate transaction, we or the relevant professionals may need to collect additional information required for due diligence, know-your-customer, anti-money laundering, sanctions screening, financing, legal, tax, title, closing, or regulatory purposes. This may include identification documents, proof of address, source-of-funds information, corporate ownership information, and transaction records. Where required, this information may be handled by attorneys, financial institutions, compliance providers, government authorities, CIREBA/MLS participants, or other authorised parties.

3. How we use personal data

We use personal data for legitimate real estate, business, compliance, security, and client-service purposes, including to respond to enquiries, connect you with an agent, send property information, arrange viewings, prepare market analyses or valuations, manage buyer/seller/tenant/landlord relationships, provide relocation and market updates, operate and improve the website, administer newsletters or marketing campaigns, assess career enquiries, maintain records, prevent fraud or misuse, and comply with legal and regulatory obligations.

We may use your contact details to follow up about your enquiry, send relevant property or market updates, and provide information about our services. You can opt out of marketing communications at any time, but we may still send non-marketing communications relating to an active enquiry, transaction, legal requirement, or service request.

We do not sell personal data.

4. Legal bases and privacy principles

We process personal data only where we have an appropriate basis to do so, which may include your consent, performance of a contract or steps requested before entering into a contract, compliance with legal obligations, protection of vital interests, performance of a public function where applicable, or our legitimate interests where those interests are not overridden by your rights and freedoms.

We aim to follow the recognised privacy principles of fair and lawful processing, purpose limitation, data minimisation, accuracy, storage limitation, respect for individual rights, security, and appropriate controls for international transfers.

5. How we share personal data

We may share personal data where reasonably necessary for the purposes described in this Policy, including with KW Cayman agents and team members, Keller Williams franchise/network resources where relevant, listing platforms and MLS/CIREBA-related systems, attorneys, lenders, banks, valuers, surveyors, inspectors, appraisers, strata managers, developers, landlords, sellers, buyers, tenants, government or regulatory authorities, AML/KYC and compliance providers, insurance providers, transaction counterparties and their representatives, website hosting providers, CRM and lead-management tools, email delivery providers, analytics providers, IT/security vendors, professional advisers, and other service providers acting on our behalf.

We may also disclose personal data if required or permitted by law, court order, subpoena, regulation, professional obligation, fraud/security investigation, enforcement of our rights, protection of our users or the public, or in connection with a merger, acquisition, restructuring, sale of assets, or transfer of business operations.

Where practical, we require service providers to use personal data only for authorised purposes and to protect it appropriately.

6. Cookies, analytics, and similar technologies

Our website may use cookies, pixels, local storage, server logs, analytics tools, advertising tools, and similar technologies to operate the site, remember preferences, understand traffic and performance, measure campaigns, protect against abuse, and improve user experience.

You can control cookies through your browser settings. Disabling cookies may affect some website functionality. If we deploy additional advertising or analytics technologies, those providers may process technical or usage data under their own privacy terms.

7. International transfers

Because real estate enquiries, website infrastructure, cloud hosting, CRM, email, analytics, franchise resources, transaction participants, and professional advisers may be located outside the Cayman Islands, your personal data may be transferred to, stored in, or accessed from other countries. Those countries may have different data protection laws than the Cayman Islands.

Where we transfer personal data internationally, we take steps designed to ensure an appropriate level of protection, such as using reputable service providers, contractual protections, access controls, and other safeguards appropriate to the circumstances.

8. Security

We use reasonable technical, organisational, and administrative measures designed to protect personal data against unauthorised access, loss, misuse, alteration, disclosure, or destruction. These measures may include access controls, secure hosting, monitoring, vendor controls, and internal handling procedures.

No website, email system, or internet transmission is completely secure. You should avoid sending highly sensitive information through ordinary website forms or unencrypted email unless requested through an appropriate secure process.

9. Retention

We keep personal data only for as long as reasonably necessary for the purposes for which it was collected, including to respond to enquiries, provide services, maintain business and transaction records, meet legal, regulatory, accounting, tax, professional, AML/KYC, dispute-resolution, fraud-prevention, and insurance requirements, and protect our legitimate interests.

Retention periods vary depending on the type of information and the context. When personal data is no longer required, we will delete, anonymise, or securely archive it in accordance with our operational and legal obligations.

10. Your rights

Subject to applicable law and lawful exemptions, you may have rights to request access to your personal data, request correction of inaccurate or incomplete data, request deletion or restriction of processing, object to certain processing, withdraw consent where processing is based on consent, request information about how your data is used or shared, and complain to the Cayman Islands Ombudsman or another competent privacy authority.

To exercise privacy rights, contact us at hello@kellerwilliams.ky. We may need to verify your identity before responding. We will respond within the timeframe required by applicable law.

11. Third-party links and listing data

Our website may link to third-party websites, listing platforms, MLS/CIREBA resources, social media platforms, map services, video platforms, payment or transaction tools, and other external resources. We are not responsible for the privacy practices, content, accuracy, or security of third-party websites or services.

Property listing information may be supplied by sellers, agents, developers, MLS/CIREBA-related data feeds, or other third parties. Listing data is provided for informational purposes and may be subject to separate terms, restrictions, and verification requirements.

12. Communications and marketing choices

If you sign up for updates or submit an enquiry, we may contact you by email, phone, text/WhatsApp, or similar channels where appropriate. You may ask us to stop sending marketing messages at any time by using the unsubscribe link where provided or by contacting us directly.

Opting out of marketing does not stop service, transactional, compliance, or relationship communications where we have a lawful reason to send them.

13. Changes to this Policy

We may update this Privacy Policy from time to time to reflect changes in law, our services, technology, vendor relationships, or business operations. The “Last updated” date above shows when this Policy was last revised. Continued use of the website or our services after an update means the updated Policy applies, subject to applicable law.

14. Contact us
